PetMart Terms of Service

Welcome to PetMart! These Terms of Service ("Terms") govern your use of the website and services operated by PetMart ("we," "us," or "our"). By using our services, including browsing or purchasing from our store powered by Shopify, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the services.

1. Access and Account

You must be at least the age of majority in your jurisdiction to use our services. You agree to provide accurate, current, and complete information when creating an account or making a purchase. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.

2. Products and Descriptions

We strive to present accurate product descriptions and images, but we cannot guarantee colors or product details will be exactly as displayed. Products are subject to availability and may be discontinued or changed at our discretion without notice.

3. Orders and Acceptance

All orders are subject to acceptance. We reserve the right to refuse, cancel, or limit any order. Payment must be received before we accept your order. If your order is canceled, you will be notified using the contact information you provided.

4. Pricing and Billing

Prices may change without notice. All prices are listed in the local currency and exclude taxes, shipping, and other applicable fees unless otherwise stated. You agree to provide accurate billing and payment information. You are responsible for all charges incurred, including applicable taxes.

5. Shipping and Delivery

Delivery estimates are not guaranteed. Title and risk of loss transfer to you once we deliver your order to the shipping carrier. We are not responsible for delays beyond our control.

6. Intellectual Property

All content on our site (text, graphics, logos, etc.) is the property of PetMart or its licensors and protected by law. You may not reproduce or distribute our content without permission.

7. Third-Party Tools and Links

Our services may include tools and links to third-party websites. We are not responsible for third-party content or services, and your use is at your own risk.

8. Relationship with Shopify

PetMart uses Shopify to host and power our store. All transactions are between you and PetMart. Shopify is not responsible for product issues or customer service inquiries related to your order.

9. Privacy

Your use of our services is also governed by our Privacy Policy. Shopify may also collect and process personal information as outlined in their Privacy Policy.

10. Feedback

Any feedback or suggestions you provide may be used by us without compensation or obligation. You represent that your feedback is not confidential and does not violate any third-party rights.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information without prior notice, including after an order has been placed.

12. Prohibited Uses

You agree not to use our services for unlawful or prohibited activities, including but not limited to fraud, harassment, or infringement of intellectual property. We reserve the right to terminate your account if you violate these terms.

To the maximum extent permitted by law, PetMart shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the services or products.

16. Indemnification

You agree to indemnify and hold harmless PetMart, Shopify, and affiliates from any claims or liabilities arising from your use of the services or violation of these Terms.

17. Governing Law

These Terms are governed by the laws of Uganda. You agree to submit to the jurisdiction of the courts in Kampala, Uganda.

18. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on this page, and your continued use of the services constitutes acceptance of those changes.
